TERMS & CONDITIONS

Binding Agreement

In order to enter the Tracks4Crafts video contest (“Contest”), you must agree to these Official Terms and Conditions (“Terms”). These Terms form a legally binding agreement between you and Skillman.eu Secretariat – Centro Studi "Cultura Sviluppo" (CSCS), the owner and hosting entity of the Tracks4Crafts video contest for the purposes of publication, data processing and operational management of the Contest. 

The Tracks4Crafts consortium partners may benefit from the rights and licences granted under these Terms for educational, promotional, dissemination, archival and project-related purposes, as expressly provided below. However, unless otherwise agreed in writing, they are not separate contractual counterparties under these Terms. 

Please read these Terms carefully. If you do not agree to them, you are not eligible to participate in the Contest. By registering for the Tracks4Crafts video contest and/or submitting a Tracks4Crafts video contest entry, you acknowledge and accept these Terms. 

Your Rights and Responsibilities

You represent and warrant that: (i) you are at least eighteen years of age; (ii) you have the right and authority to enter the submission; (iii) the submission is the original work of you or of the people and or the organisations you’ve listed; (iv) you comply with all the eligibility requirements shown above and (v) your entries do not violate any applicable laws or regulations in your country and/or state of residence and nor in Italy where the owner of the Tracks4Crafts video contest is resident and Germany, where the data server is resident. For any entry in which a person is recognizable, you represent and warrant that you have secured a model release from the subject or, in the case of a minor, the subject’s parent or guardian and that you will provide it to  Skillman.eu Secretariat - Centro Studi "Cultura Sviluppo", upon request. For any entries of student submissions, you represent and warrant that the work was solely produced by a student or students and that you will provide proof of student status to  Skillman.eu Secretariat - Centro Studi "Cultura Sviluppo", upon request. 

The creator(s), and the people and organisations listed as such, will be credited whenever reasonably possible when the video is used by Skillman.eu Secretariat – Centro Studi "Cultura Sviluppo" or by the Tracks4Crafts consortium partners. 


Skillman.eu Secretariat - Centro Studi "Cultura Sviluppo"’s Rights and Responsibilities

By registering for the Tracks4Crafts video contest and/or submitting your entry, you grant to Skillman.eu Secretariat – Centro Studi "Cultura Sviluppo" (CSCS), and to the Tracks4Crafts consortium partners, a non-exclusive, worldwide, perpetual, irrevocable, royalty-free and fully paid-up licence to use, copy, reproduce, adapt, modify, distribute, communicate, make available and publicly display such entries, in whole or in part, in any media now existing or subsequently developed, including physical exhibitions, online platforms, project websites, events and dissemination channels associated with the Tracks4Crafts project. 

This licence is granted for educational, promotional, publicity, exhibition, archival, scholarly, research, communication, dissemination and project legacy purposes, including display on the tracks4crafts.eu website and on other channels used by Skillman.eu Secretariat – Centro Studi "Cultura Sviluppo" or by the Tracks4Crafts consortium partners. 

The licence does not transfer ownership of copyright from the participant, creator or author. However, once granted, the licence remains valid and cannot be withdrawn, except where required by applicable law or where the submitted content is found to be unlawful, infringing, or otherwise unsuitable for publication. 

Skillman.eu Secretariat – Centro Studi "Cultura Sviluppo", as the hosting entity and data controller for the Contest, reserves the right to remove entries for legal, technical, ethical, reputational or operational reasons, without this affecting the continued validity of the licence already granted for lawful uses. 

All winners are notified by email. 

Skillman.eu Secretariat – Centro Studi "Cultura Sviluppo", acting as coordinator of Tracks4Crafts dissemination activities, and the Tracks4Crafts consortium partners may use submitted videos for promotional and marketing purposes for an indefinite period, including before the announcement of winners for the ongoing edition. 

Intellectual Property

By registering for the Contest and/or submitting an entry, you represent and warrant that all components of your entry are original works and are not derived from, or infringing upon, the works or rights of others. You represent and warrant that it is your responsibility to ensure that you have obtained all required releases, licences, permissions and clearances necessary to submit the entry and to grant the licence provided under these Terms. 

Skillman.eu Secretariat – Centro Studi "Cultura Sviluppo" and the Tracks4Crafts consortium partners shall not be responsible for any copyright infringement, third-party claim, or misuse arising from your entry, from content supplied by you, or from any failure by you to obtain the necessary rights, permissions or releases. 

The craftsperson featured in the video shall be appropriately credited as the source of knowledge and inspiration for the documented craft whenever reasonably possible. Where the video documents a craftsperson’s work, process, image, knowledge or contribution, the participant is responsible for ensuring that the craftsperson has given their Free, Prior and Informed Consent (FPIC) before filming and submission. 

Such consent concerns the filming and documentation process and must be obtained before the video is submitted. Any subsequent request by a craftsperson or participant to restrict, withdraw or remove content will be assessed in accordance with applicable law, the rights already granted under these Terms, the legitimate interests of the Contest, and any legal obligations connected with attribution, copyright, archival documentation and accountability. 

Intellectual property rights of creators, authors and third parties related to creative works, designs, symbols, products, knowledge, music, images or other materials used in the audiovisual production process remain protected. This includes copyright, trademarks, patents, industrial design rights, geographical indications, certification and collective marks, and trade secrets. 

Any intellectual property infringement or misuse may result in immediate disqualification and forfeiture of eligibility to participate in the Contest. 

All intellectual property rights in any entries that belong to the participants, creators or authors will remain with them. However, the licence granted to Skillman.eu Secretariat – Centro Studi "Cultura Sviluppo" and to the Tracks4Crafts consortium partners under these Terms will remain valid, including after the end of the Contest and the Tracks4Crafts project. 

Participants may contact info@tracks4crafts.eu to exercise their rights concerning personal data or to submit a reasoned request concerning the use of their submitted content. Requests relating to personal data will be handled in accordance with GDPR and applicable Italian law. Requests relating to submitted content will be assessed separately from data protection requests and in accordance with the licence granted under these Terms, copyright requirements, attribution obligations, archival needs, and any applicable legal obligations

Data Stewardship, Use and Cultural Heritage Commitments

Only the minimum personal data necessary for contest administration, identification, attribution, communication and lawful publication of submitted materials is collected and processed by authorised staff at Skillman.eu Secretariat – Centro Studi "Cultura Sviluppo" and, where necessary for project purposes, by authorised Tracks4Crafts consortium partners. 

Personal data is securely stored on servers located in Germany in compliance with EU GDPR and applicable Italian legislation. Access to personal data is strictly limited to authorised project and administrative staff working on the Tracks4Crafts initiative. No third parties will have access unless explicitly authorised by participants or required by law. 

Certain personal data, including information necessary to identify the participant, creator, author or craftsperson connected with a submitted video, may need to be retained for as long as necessary to document authorship, attribution, copyright, consent, accountability, lawful publication, project reporting, archival purposes and compliance with applicable legal obligations. 

Any data access for research, policy, or archival purposes will be anonymised unless identification is necessary for attribution, copyright, consent documentation, cultural heritage integrity, or unless otherwise consented to. 

Aggregate, anonymised data from the video contest may be used for educational, research and policy development purposes related to cultural heritage, craft preservation and creative practices. Any public presentation of findings will not identify individuals without prior consent, unless identification is necessary for attribution or lawful publication of submitted materials. 

Tracks4Crafts commits to ethically documenting and sharing intangible cultural heritage. Video entries that include traditional knowledge or craft processes may be preserved as part of a broader heritage archive and may be curated for exhibitions, educational use, research, communication, dissemination or digital publication, in accordance with the licence granted under these Terms. 

Metadata associated with submissions may include contextual details such as: title of the work, craft tradition represented, location, involved craftsperson(s), language spoken, consent documentation, authorship and attribution information, and short descriptions of cultural relevance. This metadata helps maintain the cultural integrity of the material and supports responsible archival, educational, academic and dissemination use. 

INDEMNIFICATION

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU INDEMNIFY AND AGREE TO KEEP  Skillman.eu Secretariat - Centro Studi "Cultura Sviluppo" INDEMNIFIED AT ALL TIMES FROM AND AGAINST ANY LIABILITY, CLAIMS, DEMANDS, LOSSES, DAMAGES, COSTS, AND EXPENSES RESULTING FROM ANY ACT, DEFAULT OR OMISSION BY YOU AND/OR A BREACH OF ANY WARRANTY BY YOU SET FORTH HEREIN. TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU INDEMNIFY AND AGREE TO KEEP INDEMNIFIED  Skillman.eu Secretariat - Centro Studi "Cultura Sviluppo" AT ALL TIMES FROM AND AGAINST ANY LIABILITY, ACTIONS, CLAIMS, DEMANDS, LOSSES, DAMAGES, COSTS, AND EXPENSES FOR OR IN RESPECT OF WHICH  Skillman.eu Secretariat - Centro Studi "Cultura Sviluppo" WILL OR MAY BECOME LIABLE BY REASON OF OR RELATED OR INCIDENTAL TO ANY ACT, DEFAULT OR OMISSION BY YOU UNDER THESE TERMS INCLUDING WITHOUT LIMITATION RESULTING FROM OR IN RELATION TO ANY BREACH, NON-OBSERVANCE, ACT OR OMISSION WHETHER NEGLIGENT OR OTHERWISE, PURSUANT TO THESE TERMS BY YOU. TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AGREE TO HOLD  Skillman.eu Secretariat - Centro Studi "Cultura Sviluppo" ITS RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES AND ASSIGNS HARMLESS FOR ANY INJURY OR DAMAGE CAUSED OR CLAIMED TO BE CAUSED BY PARTICIPATION IN THE AWARDS AND/OR USE OR ACCEPTANCE OF ANY AWARD WON. 


General Conditions

The Contest is governed by the laws of the Italian State, excluding its body of law regarding conflict of law. All state and local laws and regulations apply. By participating in the Contest, you agree to be bound by these Terms and by  Skillman.eu Secretariat - Centro Studi "Cultura Sviluppo", which are final and binding on all matters pertaining to the Contest. To the extent permitted by law, the rights to litigate, to seek injunctive relief, or to any other recourse to judicial or any other procedure in case of disputes or claims resulting from or in connection with the Contest are hereby excluded, and you expressly waive any and all such rights. You and  Skillman.eu Secretariat - Centro Studi "Cultura Sviluppo"   hereby agree that the forum and venue for any dispute regarding the Awards shall be the city of Pistoia, in Italy, and the parties hereto waive any venue objections. If the controversy or claim is not otherwise resolved through direct discussions or mediation, it shall then be resolved by final and binding arbitration administered by Judicial Arbitration and Mediation Services in accordance with its streamlined arbitration rules and procedures. The Arbitration and Mediation rule for arbitrator selection shall be followed, except that the arbitrator shall be experienced and licensed to practice law in Florence. The parties agree to share equally in the arbitration costs incurred. If any provision of these Terms shall be held by a court of competent jurisdiction to be contrary to law, that provision will be enforced to the maximum extent permissible, and the remaining provisions of these Terms will remain in full force and effect. 

THE REMEDY FOR ANY CLAIM SHALL BE LIMITED TO ACTUAL DAMAGES, AND IN NO EVENT SHALL ANY PARTY BE ENTITLED TO RECOVER PUNITIVE, EXEMPLARY, CONSEQUENTIAL, OR INCIDENTAL DAMAGES, INCLUDING ATTORNEY’S FEES OR SUCH RELATED COSTS OF BRINGING A CLAIM, OR TO RESCIND THIS AGREEMENT OR SEEK INJUNCTIVE OR ANY OTHER EQUITABLE RELIEF.


GDPR statement for personal data protection policy for the video contest

What is our legal framework?

All personal data are processed in accordance with the Italian Personal Data Protection Code, which contains provisions to adapt national legislation to Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, repealing Directive 95/46/EC. 

Why do we process personal data?

Personal data are processed to manage video applications and to contact applicants throughout the contest to share relevant information exclusively related to the Tracks4Crafts video contest. 

What is the legal basis for processing personal data?

Personal data are processed by Skillman staff members, based on the consent of the participants in the application for the Tracks4Tracks video contest. Users may withdraw their consent at any time by contacting this email address: dissemination@tracks4crafts.eu. All processing of personal information will cease once the user withdraws consent; however, any processing that has already taken place remains lawful.

How long will Skillman staff members keep users' personal data?

Personal data will be stored for as long as necessary to manage the Tracks4Crafts video contest, ensure lawful publication and dissemination of submitted materials, document authorship and attribution, comply with project reporting requirements, and fulfil applicable legal obligations. 

If a participant withdraws consent for processing activities based solely on consent, such processing will cease within the legally required timeframe. However, withdrawal of consent does not affect the lawfulness of processing already carried out, nor does it require deletion of data that must be retained for legal, contractual, copyright, attribution, accountability, archival or legitimate interest purposes.

Data protection rights and right to lodge complaints with the supervisory authority

Under certain conditions, users have the right to send inquiries to Skillman staff members, such as:
    1. Access to their own personal data
    2. Obtain a copy of the personal data provided to us 
    3. Rectification of personal data in our possession
    4. Deletion of personal data for which there is no longer any legal basis for processing
    5. Revocation of consent, where processing is based on consent
    6. Restriction of the way in which we process users' personal data, within the limits established by legislation for the protection of personal data.

The right to erasure is not absolute and may be subject to legal limitations, including where retention is necessary for compliance with legal obligations, establishment, exercise or defence of legal claims, copyright and attribution requirements, accountability, archival purposes, or the legitimate interests connected with the lawful publication and dissemination of submitted materials.

The exercise of these rights is subject to some exceptions aimed at safeguarding public interest (for example, prevention or identification of crimes) and our interests (for example, maintenance of professional secrecy). If participants exercise their rights, Skillman will verify their entitlement to do so and respond within the legally required timelines.
